This is a court order requiring a third party (typically the platform or internet service provider) to disclose information about the identity of the anonymous publisher.

    To obtain a Norwich Pharmacal order, you must demonstrate:

    • A good arguable case that wrongdoing (defamation) has occurred
    • The respondent (platform/ISP) is mixed up in the wrongdoing, even innocently
    • The order is necessary to enable the applicant to pursue their claim
    • The order is proportionate — the importance of the information outweighs any privacy concerns

    What Information Can Be Obtained?

    Depending on the platform and the circumstances, disclosure may include:

    • The name and email address used to create the account
    • IP addresses associated with the account activity
    • Phone numbers linked to the account
    • Registration details and payment information
    • Login history and device information

    Once an IP address is obtained, a further order against the internet service provider (such as BT, Sky, or Virgin Media) may be needed to identify the person using that IP address at the relevant time.

    Platform-Specific Approaches

    • Google (including YouTube): Generally cooperative with UK court orders. Their legal compliance team processes disclosure requests, though timescales can vary.
    • Meta (Facebook, Instagram): Will comply with court orders, though the process can be slow. Data may be limited depending on the user's account settings.
    • X (formerly Twitter): Has complied with UK court orders, though their approach has varied over time. Early engagement is advisable.
    • Reddit: Generally cooperative but may hold limited identifying information. IP address data may be the most useful disclosure.
    • Review platforms (Trustpilot, Glassdoor): Policies vary. Some are more cooperative than others, and review-specific protections may apply.

    Practical Considerations

    Before pursuing a Norwich Pharmacal order, consider the following:

    • Cost: Norwich Pharmacal applications typically cost several thousand pounds, though this can usually be recovered from the wrongdoer once identified
    • Speed: Applications can be made urgently if there's a risk of evidence being deleted. Platforms may delete data after a period.
    • Data preservation: Before making a formal application, your solicitor can write to the platform requesting that relevant data be preserved pending the order
    • VPNs and false details: Some defamers use VPNs or fake registration details. While this can complicate identification, it rarely makes it impossible

    After Identification

    Once the anonymous defamer has been identified, you can pursue a standarddefamation claim against them. This may include demands for removal, an apology, an injunction preventing further publication, and compensation. The fact that the defamer chose to hide behind anonymity may be taken into account by the court when assessing damages.
